Terms and Conditions
Rules for purchasing and using the world database as digital content.
The English version is provided for convenience only. In the event of discrepancies or interpretation questions, the German version shall prevail.
1. Subject Matter of the Contract
These terms and conditions govern the paid purchase of the creation and provision of an individual world database for the game “Tribal Wars” via the dieStaemmeDb platform. The service includes the technical setup and initial population of the database as well as access for authorized users.
There is no cooperation or official connection with the operator of the game “Tribal Wars” or its rights holders.
2. Contracting Party
John Bernhard
Lausitzer Str. 7
03046 Cottbus
Germany

3. Prices
Creating a new world database costs a one-time fee of EUR 3.00 (gross). The price includes statutory VAT. Different prices or promotional offers will be clearly communicated before the order process is completed.
4. Payment
Payment is processed via the integrated payment service providers (for example Stripe or PayPal). The selected payment service provider handles the payment processing; its terms of use and privacy information also apply.
5. Performance of the Service and Withdrawal for Digital Content
Performance of the service begins after the payment has been confirmed by the payment service provider. The digital content (world database) is created automatically and is usually available within a few minutes.
For consumer contracts concerning digital content that is not supplied on a tangible medium, the right of withdrawal expires once we have begun performance of the contract after you have
- expressly agreed that we may begin performing the contract before the withdrawal period expires, and
- confirmed that by giving your consent you lose your right of withdrawal once performance of the contract begins.
Details of the right of withdrawal can be found in the separate withdrawal policy on our website.
6. Availability and Liability
We strive to maintain a high technical availability of the services. Temporary restrictions or outages due to maintenance work, updates or unforeseeable events (for example force majeure or disruptions caused by third parties) cannot, however, be completely ruled out.
We are liable for damages only in cases of intent and gross negligence. In cases of slight negligence, we are liable only for the breach of an essential contractual obligation, limited to the foreseeable damage typical for the contract. The above limitations of liability do not apply in cases of injury to life, body or health or for claims under product liability law.
7. Warranty
The statutory warranty rights apply to the digital content. Please report recognizable defects within a reasonable period after discovery so that we can review and remedy them.
8. Term and Termination
This is a one-time service without an ongoing contractual commitment. Termination is therefore not required. Services that have already been fully provided cannot be reversed once the world database has been created and made available to you.
9. Applicable Law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of your country of residence remain unaffected.
10. Online Dispute Resolution and Consumer Arbitration
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr .
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board unless there is a legal obligation to do so.
11. Severability Clause
Should any provision of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, the valid provision that comes closest to the economic purpose of the invalid provision shall be deemed agreed. The same applies to any regulatory gaps.
